Ability to engage in art activities and assumption of the risk: Fancy Pencils Kids Art Studio activities may include, but shall not be limited to, the use of paints, glues, oil pastels, pencils, wood/plaster tools, sharpies, acrylic markers and other supplies. Fancy Pencils Kids Art Studio takes all reasonable precautions to reduce risk and provide safe, healthy, and enjoyable experiences.

I warrant that my child is able to follow directions for all activities in the studio. I acknowledge that risks from participation in class activities exist and that I have allowed my child to attend an art class, lesson, or camps knowing these risks and their possible consequences including personal injury.

 

Waiver and Release of Liability:

As a parent or guardian of my child, I, on behalf of myself and my child, agree that I will not hold Fancy Pencils Kids Art Studio liable for any personal injury, property damage or loss of insurance. I hereby release, discharge and agree to indemnify, defend and hold harmless Fancy Pencils Kids Art Studio and Jasmin Langsch, from all claims, actions, demands, and causes of action, of whatever kind or character that I or my child may have or claim to have against the Released Parties, for any and all injuries, harm, damages (actual and punitive), penalties, costs, losses, expenses, attorney’s fees, and/or other liability or detriment arising out of or in any way related to attendee’s participation in or attendance at any class conducted by Fancy Pencils Kids Art Studio.

 

COVID-19 Warning and Release:

An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Center for Disease Control and Prevention, kids, senior citizens and guests with underlying medical conditions are especially vulnerable. By visiting Fancy Pencils Kids Art Studio, you (on behalf of yourself and on behalf of your child) voluntarily assume all risks related to exposure to COVID-19.

 

I, on behalf of myself and my child, acknowledge and fully assume the risk of illness or death related to COVID-19 arising from being on the premises and participating in the activities and hereby covenant not to sue, release, waive and discharge (on behalf of myself and any minor children form whom I have the capacity contract) Released Parties from any liability related to COVID-19 which might occur as a result of me (or my child) being on the premises and participating in the activities.

 

The parent does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child's presence and participation in activities at Fancy Pencils Kids Art Studio and has agreed individually and on behalf of the child, to the terms of the Studio Permission and Waiver Form.

 

The parent or guardian further agrees to save and hold harmless and indemnify each and all of the Released Parties from all liability, loss, cost, claim or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor and the parents.
